Air Charter Broker Disclosure

Rutherford Aviation’s role

Rutherford Aviation acts as an air charter broker and, unless otherwise disclosed in writing for a specific transaction, acts as the customer’s agent in arranging charter flights on the customer’s behalf through FAA-certificated Part 135 direct air carriers.

Rutherford Aviation does not own, operate, maintain, or control aircraft and is not a direct air carrier. Rutherford Aviation does not exercise operational control over flights.

Direct air carriers

Flights arranged by Rutherford Aviation are operated by FAA-certificated Part 135 direct air carriers or other properly authorized air carriers, as applicable. The direct air carrier is responsible for operational control of the flight, including aircraft operation, crew assignment, maintenance, flight release, safety of flight, and regulatory compliance related to the flight operation.

Operator and aircraft review

Depending on the mission details and information received during sourcing, Rutherford Aviation’s review may include FAA operating authority, aircraft suitability, insurance documentation, crew experience, third-party safety data, and known operational considerations before options are presented. Review language should not be understood as a guarantee of any operator’s overall safety, quality, or performance.

Customer disclosures

Before entering into a charter contract or booking, customers should receive appropriate information regarding the selected direct air carrier, aircraft, itinerary, pricing, cancellation/refund terms, Rutherford Aviation’s broker and agency role, and other required disclosures. The timing and content of these disclosures should be incorporated into Rutherford Aviation’s quote, contracting, invoice, payment, and trip-confirmation workflow.

Insurance disclosure

Before entering into a charter contract or booking, Rutherford Aviation should disclose whether it maintains insurance covering air charter broker services and, if insurance is maintained, the applicable coverage limits or where those limits are stated in the quote or customer agreement.

Compensation

Rutherford Aviation may receive compensation for arranging charter services. Compensation may be structured as a broker fee, commission, markup, or other agreed compensation depending on the transaction, quote format, operator relationship, and customer agreement.

No operational control

Rutherford Aviation does not direct or control aircraft operation, crew decisions, maintenance, flight release, weather decisions, routing decisions, or other operational-control matters. Those matters remain with the direct air carrier and its authorized personnel.

Legal review recommended

Air charter broker advertising, solicitation, disclosures, payment handling, cancellation/refund terms, and customer communications may be subject to U.S. Department of Transportation and other legal requirements, including 14 C.F.R. Part 295 where applicable.
